What is BIR Form 2316?
BIR Form 2316, officially titled the Certificate of Compensation Payment/Tax Withheld for Compensation Payment With or Without Tax Withheld, is a document issued by Philippine employers to their employees. It certifies the total compensation paid and the total taxes withheld during the calendar year.
The form is issued by the Bureau of Internal Revenue (BIR) and is a cornerstone of the Philippine income tax system for employed individuals. Under Revenue Regulations No. 2-98 (as amended), every employer who is required to withhold tax on compensation is required to give each employee a BIR Form 2316 for each taxable year.
For employees under the substitution filing scheme, the BIR Form 2316 serves as their annual income tax return substitute โ meaning they do not need to file a separate ITR (BIR Form 1700) if certain conditions are met. This makes the form critically important not just for employers but for employees as well.
BIR Form 2316 Issuance Deadline
Employers are required to issue BIR Form 2316 to employees by January 31 of the year following the taxable year. For compensation earned in calendar year 2025, the BIR Form 2316 must be given to employees on or before January 31, 2026.
Additionally, BIR Form 2316 must also be issued:
- Upon separation from employment โ the employer must issue the certificate within 30 days after the employee's last day, covering the period from January 1 to the date of separation.
- Upon request by the employee โ for purposes of claiming tax refunds, loan applications, or other legitimate needs.
Both copies (Copy 1 and Copy 2 for the employee) must be signed by the authorized representative of the employer. A third copy is retained by the employer for records purposes.
What BIR Form 2316 Contains
BIR Form 2316 is divided into several parts that together give a complete picture of the employee's compensation and tax history for the year:
- Part I โ Employee Information: Name, TIN, address, employment status (main employer or not), period of employment
- Part II โ Employer Information: Employer name, TIN, address, and RDO code
- Part III โ Compensation Income: Gross compensation income broken down into taxable and non-taxable components
- Non-taxable items include: SSS, PhilHealth, Pag-IBIG contributions, 13th month pay and benefits up to โฑ90,000, de minimis benefits
- Taxable compensation: Gross minus all non-taxable items
- Part IV โ Tax Withheld: Total tax withheld for the year, tax due, over/under-withholding
- Part V โ Substitution Filing Certification: Declaration if the employee qualifies for substitution filing
Accuracy in each section is critical. Errors in the government contributions section or in identifying which benefits are taxable vs. non-taxable will result in incorrect tax withholding figures.
Who Needs BIR Form 2316 and What is Substitution Filing?
Every employee who received compensation from an employer during the year needs a BIR Form 2316. However, the form has special significance for employees who qualify for substitution filing.
Under Revenue Regulations No. 3-2002 and subsequent issuances, employees qualify for substitution filing (and therefore do not need to file BIR Form 1700) if:
- The employee receives compensation income from only one employer in the Philippines during the taxable year
- The tax withheld is equal to the tax due on the compensation (i.e., the employer made correct withholding throughout the year)
- The employee does not derive income from other sources requiring separate filing (business income, capital gains, etc.)
For qualifying employees, the BIR Form 2316 signed by the employer substitutes for the annual ITR. The employer collects the signed certifications and submits them to the BIR as part of the Alphalist.
Employees with two or more employers in the same year (e.g., those who changed jobs) must file their own BIR Form 1700 and are not eligible for substitution filing.
Alphalist Submission and Annex A Connection
Beyond issuing BIR Form 2316 to employees, employers are also required to submit the Alphalist of Employees (Annex A of BIR Form 1604-C, the Annual Information Return of Income Taxes Withheld on Compensation) to the BIR.
The Alphalist is essentially a consolidated list of all employees and the compensation and withholding information from their individual BIR Form 2316. It must be submitted electronically via eBIRForms or eFPS by January 31 of the following year โ the same deadline as the individual certificates.
Key points about Alphalist submission:
- All companies with 10 or more employees are required to file electronically via eFPS or eBIRForms
- The Alphalist must be attached to BIR Form 1604-C
- The data in the Alphalist must exactly match the BIR Form 2316 issued to each employee
- The BIR cross-references the Alphalist against employee-filed ITRs (for non-substitution filers), so discrepancies will trigger audits
Penalties for Non-Compliance
The BIR takes non-compliance with Form 2316 requirements seriously. Potential penalties include:
- Failure to issue BIR Form 2316: The employer may be subject to a compromise penalty and face civil liability to the employee.
- Late filing of 1604-C/Alphalist: Penalties range from โฑ1,000 to โฑ25,000 per return depending on the nature of the violation, plus a 25% surcharge on any deficiency tax.
- Incorrect withholding: Under-withholding by the employer may result in deficiency assessments against the employer, with surcharges and interest.
- Failure to remit withheld taxes: Criminal liability under the Tax Code for the employer and responsible officers, with penalties including imprisonment.
Even technical errors โ such as mismatched TINs or incorrect de minimis calculations โ can trigger a Letter of Authority from the BIR.
How EngageHRIS Generates BIR Form 2316
Preparing BIR Form 2316 for 20 employees is tedious. For 200+ employees, it is a major HR project that takes weeks without proper tools. EngageHRIS tax compliance features streamline the process:
- Automatic year-end computation: The system aggregates all monthly payroll data โ basic salary, overtime, government deductions, benefits โ and populates BIR Form 2316 for each employee automatically.
- Correct categorization of taxable vs. non-taxable items: EngageHRIS applies TRAIN Law rules to correctly identify which compensation items are taxable, reducing the risk of errors.
- Alphalist export: Generate the BIR Alphalist in the BIR-prescribed format for direct upload to eFPS or eBIRForms.
- Digital signatures support: Authorized signatories can review and approve the generated certificates electronically.
